Terms of Service

These Terms of Service ("Terms") govern your use of the OwOsy website (owosy.com) and OwOsy products, including OwOsy Translate (the "Service"), operated by Phinguin ("we," "us," or "our"). By using the Service, you agree to these Terms. These Terms apply to all users of the Service, including those on the free tier.

1. The Service

OwOsy Translate is a plugin for Framer that provides AI-powered translation of website content. The plugin sends your website text to our API, which uses OpenAI's GPT-4o mini model to generate translations. Translations are written back into Framer's native localization system.

2. Accounts and License Keys

  • Free tier usage does not require a license key.
  • Paid plans require a valid license key obtained through Lemon Squeezy.
  • You are responsible for keeping your license key confidential.
  • One license key may not be shared across multiple organizations.

3. Subscriptions and Billing

3.1 Auto-Renewal

All paid subscriptions automatically renew at the end of each billing period (monthly) at the then-current price, unless you cancel before the renewal date. You will be charged on the same date each month through Lemon Squeezy.

3.2 Pricing

Current pricing is displayed on our pricing page. We reserve the right to change pricing with 30 days' notice to existing subscribers. Price changes do not affect your current billing period.

3.3 Cancellation

You may cancel your subscription at any time through the Lemon Squeezy customer portal. Upon cancellation:

  • Your subscription remains active until the end of the current billing period.
  • You will not be charged again after cancellation.
  • Your translations in Framer remain intact — they are yours.
  • Translation memory and glossary data will be deleted after your subscription expires.

3.4 Refunds

We offer a full refund within 14 days of your first subscription payment if you are unsatisfied with the Service. To request a refund, contact [email protected]. Refunds after the 14-day period are provided at our discretion. No refunds are issued for partial months. EU/EEA consumers may have additional withdrawal rights under applicable consumer protection law.

4. Usage Limits

Each plan has limits on the number of languages and words translated per month. These limits are enforced server-side. When you reach your limit:

  • Word limits reset at the beginning of each billing period.
  • You may upgrade your plan at any time to increase limits.
  • Exceeding limits will result in translation requests being declined until the next billing period or an upgrade.

5. AI Translation Disclaimer

OwOsy Translate uses AI (machine learning) to generate translations. AI-generated translations may contain errors, inaccuracies, or inappropriate content.

  • Translations are provided "as is" without any guarantee of accuracy, completeness, or fitness for a particular purpose.
  • AI translation is not a substitute for professional human translation, especially for legal, medical, financial, or other regulated content.
  • You are responsible for reviewing and approving all translations before publishing them on your website.
  • We strongly recommend reviewing translations in Framer's Localization Table and using the glossary feature for critical terminology.

6. Your Content

  • You retain all ownership rights to your website content.
  • By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing translations.
  • Your content is transmitted to OpenAI for translation processing. See our Privacy Policy for details on third-party data processing.
  • We do not use your content for any purpose other than providing the Service.

7. Acceptable Use

You may not use the Service to:

  • Translate content that violates any applicable law or regulation
  • Circumvent usage limits through automated means, multiple accounts, or license key sharing
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with or disrupt the Service's infrastructure
  • Resell the Service or its output without authorization

8. Intellectual Property

  • The OwOsy name, logo, and branding are the property of Phinguin.
  • The Service (code, design, documentation) is the property of Phinguin.
  • Translations generated by the Service belong to you.

9. Third-Party Services

The Service relies on third-party services including:

We are not responsible for the availability, performance, or terms of third-party services.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not warrant that translations will be accurate, complete, or error-free.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not liable for damages arising from inaccurate translations, including but not limited to loss of business, reputational harm, or regulatory penalties.

11. Indemnification

You agree to indemnify and hold harmless Phinguin and its employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your publication of AI-generated translations.

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms. Upon termination, your license key will be deactivated, but your existing translations in Framer will remain intact.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Where required by applicable law, we will seek your affirmative acceptance of material changes.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the competent courts of the State of Georgia. If you are an EU consumer, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your statutory consumer rights.
